Terms of Use

The short version
Tappy is a free tool from Mobile Growth Media, LLC that replies to Instagram comments with a direct message. You connect your own Instagram account, you write the messages, and you are responsible for what they say and who receives them. We provide the tool as it is and cannot promise Instagram will always cooperate.
The rest of this page says the same thing more carefully. Using Tappy means you accept it.
Who can use it
You need to be at least 18, or old enough to enter a contract where you live. You need an Instagram Business or Creator account that you are authorised to act for. If you are using it on behalf of a company, you confirm you can accept these terms for them.
What you are responsible for
- Your messages. Everything Tappy sends is text you wrote. You are responsible for it being accurate, lawful, and not misleading.
- The links you send. Tappy does not check where they go.
- The email addresses you collect. If you gather addresses, you are the data controller for them. Marketing to those people is subject to the rules where they live, including the GDPR and PECR in Europe and CAN-SPAM in the United States. Somebody typing their address to receive one guide has not consented to a newsletter.
- Meta’s rules. Your use of Instagram remains governed by Meta’s terms and platform policies, which you must follow.
What you may not do
- send unsolicited bulk messages, or anything that would reasonably be called spam;
- impersonate anyone, or misrepresent who is messaging;
- send unlawful, hateful, deceptive, or sexually explicit content;
- use the tool to harass anybody, or to keep messaging someone who has asked you to stop;
- attempt to bypass the sending limits, or otherwise interfere with the service;
- resell access to the tool without our written agreement.
We can suspend or remove access if any of this happens, without notice where the harm is ongoing.
Sending limits
Tappy caps how many conversations an account starts per hour. The cap exists to protect your Instagram account, because a sudden flood of messages is what draws spam reports and messaging restrictions. It is adjustable within the limits Instagram itself sets, and we may lower it if an account is generating complaints.
Things outside our control
Tappy depends entirely on Meta’s platform. Meta can change its API, restrict permissions, rate limit an account, or block messaging, at any time and without warning. Any of these will stop the tool from working, and none of them are within our control.
Specifically, we do not promise that a message will be delivered, that it will land in a main inbox rather than a requests folder, that your account will not be restricted, or that the service will be available without interruption.
No warranty
Tappy is provided as it is and as it happens to be available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Limits on liability
To the fullest extent the law allows, Mobile Growth Media, LLC is not liable for indirect or consequential loss, lost profit, lost revenue, lost data, lost leads, or damage to reputation or goodwill, arising from your use of Tappy or from being unable to use it.
Because the tool is free, our total liability to you for any claim is limited to one hundred euros.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Your data and ours
The Privacy Policy explains what is collected and how to have it deleted. You keep ownership of your flows and your leads. We keep ownership of the tool itself.
You grant us permission to process your content only so far as is needed to run the service for you.
Ending it
You can stop at any time by disconnecting Instagram from the Account page, which deletes the stored access token and pauses every flow.
We may withdraw the tool, or any part of it, with reasonable notice where we can give it. If we do, you will have the opportunity to export your leads first.
Changes to these terms
We may update these terms. The date at the top shows when they last changed, and continuing to use Tappy after a change means you accept it. If a change materially reduces your rights, we will say so in the dashboard rather than relying on you noticing.
Law and contact
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The state and federal courts located in Delaware have exclusive jurisdiction, except where consumer law in your own country entitles you to bring proceedings where you live and to the protection of its mandatory rules.
